Promotion Terms

§ 1. General provisions
- These Terms set out the rules for participating in the "Backup Readiness Score" promotion (the "Promotion"), run via the viability.pl website.
- The Promotion is organized by Viability Sp. z o.o., with its registered office in Wrocław (ul. Krupnicza 2/4, 50-075 Wrocław, Poland), entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000525760, NIP 5213679828 (the "Viability" or "Organizer"); contact e-mail: care@viability.pl.
- Terms used in these Terms have the following meaning:
- BRS Assessment – a free, interactive self-assessment of backup system readiness (Backup Readiness Score), made available by the Organizer on viability.pl, consisting of 25 questions across 5 dimensions.
- Participant – an entrepreneur (a natural person conducting business activity, a legal person, or an organizational unit without legal personality) using the BRS Assessment in connection with their business activity.
- Report – an automatically generated summary of the BRS Assessment result, containing the score, the rating of individual dimensions, and recommendations, sent to the Participant's e-mail address and made available on a dedicated result page.
- Voucher – a unique, individually generated discount code entitling the holder to a discount on the Supervision Service on the terms set out in § 3.
- Supervision Service – Viability's paid service named "Backup Infrastructure Supervision", comprising an online session, off-line analysis and a report, provided under a separate order or agreement.
- The Promotion is addressed exclusively to entrepreneurs (B2B relationship). The Participant is not entitled to consumer rights under the Polish Act of 30 May 2014 on consumer rights.
§ 2. Conditions of participation
- Participation in the Promotion is voluntary and free of charge.
- To receive the Report and the Voucher, the Participant must jointly:
- complete all questions of the BRS Assessment;
- provide a valid business e-mail address;
- consent to the processing of personal data for the purpose of preparing and sending the Report.
- Consent to receive marketing information is voluntary and is not a condition for receiving the Report or the Voucher.
- The Voucher is granted in the amount of one per entrepreneur (one entity / one e-mail domain). The Organizer may refuse to honor additional Vouchers obtained by the same entity from different e-mail addresses.
- The BRS Assessment does not require the Participant to provide a company name. The Participant provides only the e-mail address required to deliver the Report.
§ 3. Discount voucher
- The Voucher entitles the holder to a 20% discount on the Backup Infrastructure Supervision service. The value of the Service is PLN 5,500 net; after the discount the price is PLN 4,400 net.
- The Voucher is:
- personal to the entity for which it was generated and may not be transferred to third parties;
- single-use – it entitles the holder to use the discount once;
- valid for 90 days from the date of generation (the expiry date is indicated in the Report);
- not exchangeable for cash or any other benefits;
- not combinable with other discounts, promotions or special offers of the Organizer.
- The Voucher is redeemed by contacting the Organizer (e-mail: care@viability.pl) and providing the Voucher code before placing an order for the Supervision Service. The discount is reflected in the quote and on the invoice.
- The detailed scope, method of delivery and conditions of the Supervision Service are set out in a separate order or agreement concluded between the Organizer and the Participant.
§ 4. Nature of the Assessment and Report
- The BRS Assessment result and the Report are indicative and informational in nature. They are generated automatically based on the answers provided by the Participant and do not constitute an audit, opinion or advice of a technical, legal or compliance nature.
- The Report does not replace a detailed technical audit of the backup infrastructure or an analysis of compliance with legal or regulatory requirements.
- References to standards (including ISO/IEC 27001:2022) and regulations (including the NIS2 Directive / the Polish National Cybersecurity System) are for information and comparison purposes only.
- The Organizer is not liable for decisions made by the Participant solely on the basis of the Assessment result or the content of the Report.
§ 5. Intellectual property
- The Backup Readiness Score methodology, the content of the questions, the scoring method, the structure of the dimensions and the Report are the intellectual property of Viability and are protected by law.
- Copying, reproducing, modifying or commercially exploiting the methodology, questions or scoring mechanism without the Organizer's prior written consent is prohibited.
§ 6. Personal data
- The controller of Participants' personal data is Viability Sp. z o.o. The detailed rules for processing data, including the legal bases, purposes, retention period and the rights of data subjects, are set out in the Privacy Policy.
- The e-mail address is processed for the purpose of preparing and delivering the Report and the Voucher (basis: Article 6(1)(b) and (f) GDPR). Marketing consent, if given, constitutes a separate basis for processing (Article 6(1)(a) GDPR) and may be withdrawn at any time.
§ 7. Duration of the Promotion
- The Promotion is in force from the effective date of these Terms until further notice.
- The Organizer reserves the right to change the terms of, or end, the Promotion at any time, without giving reasons. A change to, or the ending of, the Promotion does not affect Vouchers generated before the date of the change or ending — they remain valid on the existing terms for the period indicated in § 3.
§ 8. Complaints
- Complaints regarding the Promotion may be submitted by e-mail to care@viability.pl.
- A complaint should include a description of the matter and the e-mail address used when completing the Assessment. The Organizer considers complaints within 14 days of receipt and informs the Participant of the outcome by e-mail.
§ 9. Final provisions
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code.
- Using the BRS Assessment constitutes acceptance of these Terms.
- These Terms have been drawn up in Polish and English. In the event of any discrepancy of interpretation, the Polish version prevails.
